Brodie at Element Branding® can be reached by email (firstname.lastname@example.org) phone 027 257 2433 and the Element Branding® Facebook page. Brodie will endeavour to reply to you within 24 hours although this may be longer in weekends.
An invoice will be sent to you, the client, via email for a non-refundable deposit of 25% of the design cost. Once this payment has been received, your initial design work will be emailed to you within 10 working days. All remaining fees will be invoiced and require payment made before final files are sent to you (via email or Dropbox). Payment is due within 14 days unless otherwise organised. Late payment may incur a late fee and restrict the release of your final files. If a collection service is required the collection fee will be added to the outstanding amount.
Give us what we need
The client agrees that you will supply Element Branding® all of the necessary information required for your design including text & copy, imagery & logos and guarantee to Element Branding® that any elements of copy, graphics, photos, designs, trademarks or other artwork that you provide are either owned by you or that you have permission to use them. Any sourcing of this information or imagery by Element Branding® may incur a charge.
Happy with the design?
Once a design has been approved by the client, you accept all responsibility for any use of the design in any other process, eg printing, signage, stationary, logo’s, web and social media. Element Branding® holds no responsibility for any issues or errors that happen after the design approval. Any changes that are required after approval may incur an extra design fee.
Who owns the design?
All design that are sent to you during the design process is the intellectual property of, and owned by Element Branding® and permission is not given for them to be reproduced by anyone else. Any reproduction, duplication or distributing (including online or social media) without the permission of Element Branding® or before payment is recieved is strictly prohibited by applicable copyright laws. Once a design is approved and fully paid for, you, the client, will own the rights to the design.
Lets showcase your brand
Element Branding® loves to showcase the designs we have created on our website and social media platforms after the payment is recieved. If you do not want Element Branding® to do this, please let Brodie know before payment is made.
You, the client and Brodie from Element Branding® may determine to cancel a design job at any time, if the design work /relationship is thought to be unsatisfactory by either party. Written confirmation is required for any cancellation. Ownership of all incomplete and completed files/designs shall remain the intellectual property of Element Branding® and cannot be reproduced by anyone else. Once a design job has started if you, the client, fail to make contact with Brodie for a period of 2 months then the design job will be cancelled. A cancellation invoice will be emailed with a 25% fee of the outstanding cost. All complaints can be made directly to Brodie via email.
Who is liable?
You, the client, agree to indemnify and hold harmless Element Branding® from any and all claims, demands, losses, causes of action, damage, lawsuits, judgements, including legal fees and costs, but only to the extent caused by, arising out of, the work supplied by Element Branding®.
Acceptance of Element Branding® Terms and Conditions
Design work will not begin until Element Branding® has received your acceptance of these terms and conditions by notifying us to proceed with the work and/or deposit paid.
